My brother's wife left 15 y Can it be declared void and can i re-marry

My brother's wife left me in 2005. From then they are living seprately. Can this marriage be declared void. Can he re-marry without going for divorce? What happens if he re-marry now ?
no. without divorce, can't marriage, , by the court you should declare marriage null and void then you can , otherwise you can be punished in under section 494 indian penal code,
if you remarriage, your marriage will be void
