We have been living separately for 5 months.. can we apply for divorce?
It is required that one year separation is necessary but normally when parties apply for mutual consent divorce they plead that they have been living separately for more then a year though they might be separately living for less then a year, further we normally don't recommend to state falsehood before court but parties do it in order to get the relief early.
If both parties agree to state in the mutual consent that they are residing separately for more than a year it is possible.
If the marriage was solemnized for more than two years then safely it could be stated that parties are residing separately for more than one year.

you should mention about the money in MOU and also to take care to make payment of money in either instalment (i.e 50% at time of first put up and balance at time of final decree as there will be a time gap of 6 months between first put up and final decree) or pay the money at time of final decree. all issues, cases(past, present ) should also be mentioned in detail and explicitly agreed as withdrawn
