Me and my spouse filled a petition for dissolving our marriage type of divorce is Mutual consent ,we are living separated from last two years but now we decided to take divorce as due to this covid 19 our process will be going online ,online hearing and all can any body please let me know how much time does it takes ? Can i remarry without getting divorce decree only on the basis of divorce papers .
hello sir, even though the court proceedings are going online still there are instances were the court is giving date for physical appearance also. You cannot marry without getting the divorce proceedings completed or else you will be charged with bygamy. Hi. a mutual divorce petition is divided into two parts: first motion and second motion. if both parties are agreeable it can be possibly done quickly and finished off in 1-2 months depending on the facts of the case. otherwise the normal time taken in a mutual divorce is 7-8 months af the earliest. you can only remarry once the divorce is finalised. please call for further discussions.

since there is a separation of more than two years, six months period or cooling off period can be waived by making such request in writing to court. you may finish off the process within one month. Secondly, you can't remarry on divorce papers. all you need is divorce decree, after completing second motion joint statement/judgment.
