I am living in kuwait . I have a mutual divorce case in delhi india . We both are agree for a mutual consent divorce .my wife is in delhi india . Can I take divorce from here by granting power of attorney to my father . Is it OK. Should i make any affidavit attested from here concerned authorities to file a mutual divorce petition in india . Or only the POA is the enough . It has been more than 18 months we are living separately due to corona lockdown I couldn't go india so her family get angry and I don't want to leave my job now . So I have to be stay here now . My marriage has just now completed 2 years . Thanks

You can obtain divorce by mutual consent on the basis of power of attorney given to your near relative or parents or sibling. Your proceedings can be done by video conferencing, which is now regular feature in Indian courts. You may send attorney from outside India as per their lawful procedure. Statement in court on your behalf would be given by your attorney.
