Mutual Consent Divorce Legal Memo Format

Hi Sir, My Friend recently got married on 17th May'19. Due to disputes between him and his wife, they wanted to divorce each other. His wife already had filed a case of 498A, DP sec3 & 4 with him & his family. Now they have come to a compromised situation , which they will execute in a short period and close it. We need to understand , what exactly the process in getting divorced , as it is heard that it can be done only after 1 year post marriage. Please let us know the legal Memo format, procedures, etc in make it a permanent mutual closure.

it is true that your friend cannot file for divorce within one year from the date of marriage. since they have reached to a compromise the can file for a mutual consent divorce after one year from the date of marriage.

yea it's correct divorce can be granted only after one year after filing but you have one option of filing waiver petition, as far as other cases is concerned it can be withdrawn by MOU terms and conditions mutually and file for divorce
