My mother is having only two daughters ,my father also died
Advocate H Ravi Shankar answered
hello, your mother can file for legal heir certificate in the court, there after if she wants to give the property to you, she can either give it to by way of gift deed or through proper will. if your mother gets the legal heir certificate, then she can enjoy all the rights on that property if that said property is not ancestral property.
Q: Bank's reluctance in releasing my gold
I am a software engineer and I live in USA. My father is an Account holder of AndhraBank, Kapra-sainikpuri branch. My father took gold loan using mine and my wife’s jewelry after my wedding in 2017 through his account and I was the nominee. Unfortunately my father passed away on 11th April 2018 due to cardiac arrest. I paid the bank complete gold loan amount when it was due after my father’s demise and when I wanted to relieve all my gold, bank is not releasing my gold on some pretext. They now say that they didn’t register nominee name on paper for the gold loan that my father took on my behalf when he was alive. It is the bank’s failure that they did not register nominee name on paper for gold loan and apparently I am the nominee for my father’s SB account. I explained the facts and circumstances to the branch manager and assured them that I will take full responsibility and give complete security for the gold after it is released to me. I am not able to get my own gold from the bank

hello,if you are only living legal heir to your father, you have to apply for a legal heir certificate/ succession certificate through the court. After getting the legal heir certificate, you can submit the same to the bank and ask the bank to release the movable property that your father has left.

favourable points for husband required for compormising in MC and DVC
Advocate H Ravi Shankar answered
hello, if the wife is working and earning her livelihood, then you can submit to the court about the proof of her work and earning and you can ask the court to dismiss the case as she is already having sufficient means to live. and about the DVC case, if your wife is living in adultery, or dissertation took place without sufficient cause from your wife side, on these you can contest the DVC case.
Q: RE : Will to be drafted for Transfer of Title
Existing Will (Written in a diary) to be Notarized.
Advocate H Ravi Shankar answered
hello, you can contact a lawyer for drafting of a will. notarization of a will not mandatory, but the will should be drafted on a stamp paper and it can be registered in the sub registrar office if you want. Even if the will is Registered or unregistered the will is valid if it is written with free will of testator, drafted properly and signed by two witnesses.
Q: Cheating my boyfriend on pretext of marriage and leaving me later
I am posting this as my boyfriend left me in a disturbed mental state by saying that he is leaving me after making a promise that he is going to marry me by informing our affair to his parents. He even asked me to inform our affair to my parents which I did after which he suddenly changed his mind saying that he cannot continue this affair as his parents will not agree though he told me many a time that its his decision that plays an important role in his family. We had physical relationship and 1-2 times he forced himself on me even when I objected him to do so. I don't know if I can mention the meticulous details but he continued to touch me on my vaginal area with his penis in a hard way ,to be precise all over my private part which caused me pain. I agree that I have been in a physical relationship with him with my consent excluding those 1-2 times which I mentioned above.
Advocate H Ravi Shankar answered
hello mam, you can lodge a complaint against him in the police station. with the recent ruling it is made clear that the sex on pretext of marriage amounts to rape. so you can approach nearest police station to your residence and lodge a complaint.
