Mutual consent divorce first sign done, but FiR by wife not quashed

05-Jul-2023 (In Divorce Law)
The question is, that my wife filed a FIR after I filed divorce under cruelty. Now mutual consent divorce petition was filed and first set of signatures are done in court. However, the FIR is still not quashed but is mentioned in the mutual consent divorce petition. nnShall I withdraw my case already? Or shall I wait for the FIR to be quashed?

First , there is confusion regarding which divorce you had filed whether it's contested or mutual .I want clarification regarding that and also on what basis F.I.R was filed against you. For that , I need to discuss with you regarding your matter in more detail. For further assistance, feel free to reach me.

You should wait for the FIR to get quashed and only then you should withdraw the cases. The view of High Courts are different for quashing the FIR so that should also be taken into consideration. Once the statement for quashing is recorded then you can withdraw the case.
