MUTUAL CONSENT DIVORCE APPLIED BY MY HUSBAND
16-Dec-2023 (In Divorce Law)
I Laxmi kaunder got married to tamilselvan kaunder by Hindu rituals on 4th nov 2016.we were living with my in laws and there were too many issues between us because of dowry physical and mental torture,.My inlaws tried to separate us innumerable times by creating problems in our relationship by creating characterless allegations and evrything that was possible.to separate us .My husband is not financially strong and failed to take care of me and my inlaws disliked me..because of the insufficient dowry and their greediness.I hav gone through lot of mental physical tortures and was quiet because I did not want to spoil my marriage life.At the same time I don’t beleive in forced relationship. Now i m with my parents from a period of 6 months. My husband had filed a mutual consent divorce to which I agreed as I had a hope he will change in this time period of 6 months..but to no avail.I m ready to giv him divorce but want him to be penalised for his and his family acts..
Dear queriest, as per your query you have mentioned about the fact that you have agreed to to divorce your husband mutuallyz wherein if it is the case then you have to go with that, you can't think of revenge or anything else etc, and if you want so then you cannot go with mutual and need to file 498A against them for revenge
while after 6 months one hearing will be there and judge ask you whats your opinion at that time you say I didn't want divorce i due to force sing papers
then immediately file dv application in court for mentance
and after dv file 125 for mentance and when you gate interim maintenance your husband and his relative will beg you for settlement and at that time if you are satisfied can file divorce pitition and 6 Mont waiting period also can be waived
