Mutual consent divorce and alimony issues and whom we can talk in cool

Me and my husband are part from last 3 months he is not ready for resolving the issues so he wants to file for mutual consent divorce. And i agreed but he is from a business family what if he refuses to give alimony or if he claim that this is family business i dont have any personal saving or property to pay alimony so what can i do he is only son to his parents

if only he agrees to pay you alimony then only in that case go for mutual divorce else don't go for mutual divorce.
Let him file the divorce case under sec 13 and there after let the court decide the alimony amount after going through his properties.

I have seen your query carefully. In case of filing the petition for divorce on mutual consent all the terms and conditions have to be settled before filing the petition by both parties mutually But in your case your husband is not willing to give you alimony etc. so it is not advisable to go for the petition on mutual consent in present circumstances it is better if your husband file a petition for divorce wherein you should file written statement along with a petition for maintenance under section 24 of Hindu Marriage Act. The court will grant maintenance on the basis of documents and income of your husband. if you want any further information or any other advice then contact me without any hesitation through administrator of this website.
