Mental Harassment Because Of Non Consummation Muslim Marriage

I got married 2 years ago to an NRI. Post marriage I got to know he has some physical/psychological problem due to which he could not consummate the marriage. He refused to take nay medical treatment or get tests done even visiting a doctor. I waited for 1 year but no effort from his side. A huge amount was spent on marriage. I also have not received Mehr so far. He is not agreeing for a mutual divorce so I have decided to file a case of mental cruelty and dowry against him. He being an NRI might not be able to frequently for court hearings. Will that be an advantage for me? How well are my chances to get back money and infact charge penalty for this fraud and Ill treatment?

If both the spouses are Indians and have been married under Hindu marriage Act, 1955 then they can seek divorce with mutual consent under section 13-B that provides for divorce by mutual consent.
