Dear Sir, You have not disclosed the age of your son and the grounds on which you are entitled for custody of your son. Normally, mother is entitled for custody of the child till he attains the age of 5 years. If mother is involved in adultery then it will be a good ground to claim immediate custody of child by a father

you need file for a G&WC petition before the jurisdictional family. There you can request the judge about the custody of your son and can even request for visitation rights until and unless case is disposed.

you may file a case custody and visitation. on what ground the son has been taken away, how long he is not with you. whether he wants to stay with you and also other facts are required to be known to guide properly but to getting custody you can file a case under gaudian and wards act .
