You should immediately Consult a lawyer and file a case under Muslim personal Law for divorce rights, maintenance, and recovery of your husband took money and promised alimony and property transfer but failed, you may also file a criminal complaint for cheating and breach of trust. Preserve all written agreements, proof of joint ownership, and bank loan details. You can seek injunction to stop the bank from auctioning until the matter is resolved. Also, claim monthly maintenance if he fails to pay.

You have the right to claim maintenance (₹10,000/month) and alimony (₹10 Lakhs) if your husband has stopped payments, under the Muslim Women (Protection of Rights on Divorce) Act. If he hasn’t transferred the apartment ownership as promised and defaulted on the bank loan, you can file a civil suit for the transfer of property and seek specific performance of the agreement. Additionally, you may negotiate with the bank to take over the loan payments.

Under Muslim law, you can seek divorce through Khula or Talaq proceedings, but since he failed to honour the written agreement for alimony and maintenance, you can also file a case for recovery of agreed amount and arrears under Section 125 CrPC / Domestic Violence Act. For the joint apartment, you can file a partition and injunction suit to protect your share, and also seek stay on bank auction till dispute is resolved. Preserve all written agreements and witness details to strengthen your case. Immediate legal action is advisable.

Under Muslim law and general Indian law, your husband is bound to honour the written alimony and maintenance terms. You can file a suit for recovery of the promised ₹10 lakh and arrears of ₹10,000/month under the agreement, along with a claim for mehr and iddat maintenance if applicable. For the joint apartment, since he took cash and defaulted on EMIs, you can seek injunction to stop bank auction and file for partition/transfer as promised. Criminal breach of trust (Sec. 406 IPC) may also apply.
