In the MoU of divorce by mutual consent, I have put a condition that my wife will have to withdraw all her cases before filing the second motion, in which the FIR will also have to be quashed by the Hon'ble Delhi High Court. i) Can the Hon'ble Delhi High Court raise any objection on this condition? ii) Like how we have filed a petition for quashing 498a FIR without completing the second motion. I will be grateful to you if you answer the above questions point-wise for my better understanding.

1. High court would not raise any objection to the clause of settlement and quashing of the FIR as in the matrimonial dispute if the issues are settled amicably then the court do not drag the lis unnecessarily. 2. Quashing of the FIR is advisable after the completion of second motion. However if the MOU articulated any clause which is fulfilled before the second motion then FIR can be quashed. For any further legal assistance please feel free to contact Thanks

i). Since you have already gone through a settlement through a MOU then the HC will quash the FIR without any objections. ii). You can file for quashing anytime but since you have already mentioned in the MOU that it will be quashed before filing of second motion. For any other legal assistance I am just a call away.
