Matrimonial issue/ dowry and domestic violence

20-Feb-2023 (In Divorce Law)
My wife and I are contesting a case in Ludhiana lower court where she alleged that my family and I asked for dowry and used domestic violence on her. She is asking for maintenance and right to stay. But the case is she left me a year ago and took my documents and important stuff along with jewellery. What should I do. We got married as per Sikh rights.

Dear client The best way forward would be in case you want to get separated is would be to file for a mutual consent divorce which will save you time and money both. In case any false cases have been filed against you, they would have to be withdrawn before proceeding for a multual consent divorce. Rest would need to peruse your documents to guide you further. feel free to get in touch to discuss.

You have both civil remedies as well as ciminal remedies. In the present case, the wife is entitled to take along with her all the gifts and items that were given to her at the time of marriage. Other than that, if she takes anything else, you can file a criminal case against her.
