I have got married on 19 th June 2017. My parents have both expired so i live with my wife alone.Since marriage she always complain that she has been force to marry by her sisters and she does not want to stay in the house alone. She frequently visited her parental house and used to stay for a long period of time.There is a meeting held on middle of September 2017 where both the sides met and where i told them whether she will continue her maritial life smoothly or not.And there it was decided that she will do it accordingly. But on 18.10.2017 she left your matrimonial home on her own
wish and went to your parents home.From then onwards in spite of several phone calls and requests, she never returned and have not even tried to resume the conjugal life again.Three letters are sent on 21.5.18,1.6.18 and 28.6.18 requesting her to return back but she never responded. On the end of August 2018 she instead filed section 125 crpc and blamed me of false dowry harassment . What i will do .
You need to properly fight out the 125, file a case for restitution of conjugal rights and also if you can try make her write on whatsapp or email or sms that she doesnt want you to reside with your aged parents, it will be a solid ground for divorce with evidence in hand, play it tactfully, there is nothing to fear, many get confused and fall in traps and act irrantional, act technically all will be good.
Firstly use all those three letters in 125 case as a proof that u want her back but inspite of your repeated requests she has not. She left you home intentionally without any reason on ur part. Secondly mention in 125 case reply of urs that when you want her back then she has s not eligible for any maintenance. it's her tricks and bad practice to reap money from you. If she comes back you will take care of her maintenance and all necessary things as required but Indian law no way allow any women to take advantage of laws to harassed husband like this.
lastly file a restitution of conjugal rights and also lodge a GD simultaneously narrating entire story and that inspite of your honest and repeated efforts she left you for no reason and now she is demanding money from you. it's pa harassment.
