married in 2014 husband is abusive want to file for divorce what to do

Sir. I want divorce from my husband. We marry on 2014 without family consent and we are living seperately till now. A situation for divorce arise due to his bad behaviour and he abuse and beaten me when he meet. He did not ready for taking me into his home and threat me to destroy my life. I doesn't have any evidence related to my marriage. All are kept with him. I did court marriage in ghaziabad court. So i have to file for divorce petition in the same court where i was married?Please tell me what is procedure for divorce without going to court again and again?

There are certain special provisions forDivorce which are specially for wife under Hindu marriage Act .You can file Divorce petition taking ground of cruelty ,as you mentioned that it was a court marriage ,this is a conclusive evidence of your marriage and regarding filing of petition it could be done in any court where you or your Husband reside or had lived earlier together .

Yes you have to file a divorce in family court of Ghaziabad, on a ground of cruelty you can ask for a divorce from him but it would take time if he is not agree for a mutually consent divorce, However his behaviour is cruel towards you therefore file criminal complaint against the husband for subjecting to cruelty. And firstly you may file a complaint under domestic violence and for maintenance as well.

Yes you can get divorce. If mutual consent is there then you won't need to go to court again and again. If not then you need to contest for divorce and will need some more time. Regarding the petition, you can file it that place where you reside now or you two last reside together etc.

There is no way to take divorce without court.
U have two legal options.
(1) u can claim for mantiance under section 125 of Cr. P. C.
(2) U can also file 498(a) case against him.
* If he is also ready for divorce then u can file divorce by metual consent.it will be easy for u and it may be completed in six months.
