Q: Grounds on which husband can avoid paying alimony

My wife left me 3 and a half years before and is not willing to stay with me since she was having an extramarital affair, however, I don't have evidence to prove it, we don't have kids, she stayed with me for like 13 yrs now is it possible to get divorce from her without paying alimony? Since she is not agreeing to give divorce without having alimony. She left the home on her own and is working as well. We live in Noida, however, our marriage is registered from M.P. Can I file divorce petition from MP or do I need to file in Noida?

There are many grounds to get divorce without having to pay alimony. Extra marital affairs is one of them. Leaving husband for without just reason is also a ground. You can file for divorce petition either in M.P. or in Noida where u both resided.



Q: How long it takes to get a stay in 498A case

How much time to get Stay order from Allahbad High court for 498a and 406 case?? it's around 18 days and I still didn't get stay order. my lawyer says that it will take minimum 15 days I think my lawyer misguided me.. please help..?

I hope u mean to say stay on arrest in case of 498a. Is hearing done for the application? Stay order is an urgent hearing application and whatever order whether in favor or against is granted the very same day after arguments.



Q: What to do an online bank fraud of 15 lacs

My father's account in ICICI bank was subject to a fraud of 11 lacs rupees in May. 1. My father didn't share his debit card details or account details with anyone. 2. The Fixed Deposit of 20 lacs was broken online without his signature or Adhaar card details. 3. Due to our mistake, our phone was hacked and thats why we didn't receive OTP. Bank completed the investigation and is saying that it doesn't hold any liability 4. We want to know if we can file a case against the bank for following reasons: FD broken without signature, 11 lacs transferred within 15 minutes through IMPS and wasn't stopped by bank Debit card details were compromised without we sharing it with anyone.

Did you reported fraud within 3 days of fraud? If there is some negligence on the bank part and not your part then you can definitely ask for bank to compensate the amount. But proper advise can be given only after understanding the whole circumstances of the case.



Q: What to do if I am not satisfied with the writ order

The first senior most lecturer given charge of principal. He does not possess the essential qualification. I, second senior possess two out of three prescribed qualifications. I filed a writ on 25 may 2017 . Till date no hearings and the in charge principal has not submitted his counter affidavits. 1. What should be done for prompt hearing and court direction. 2. Can I seek retirement with full payment as I am humiliated by command and control by unqualified in charge principal. Please render guidance preferring no.2.

In which court did you apply for writ petition? Hopefully in some high court. Its been too long. You must hire a good lawyer and go for urgent hearing writ petition. For preference no.2 it is not clear what do you mean by retirement with full payment? You can seek voluntary retirement subject to department having such scheme.



Q: One brother constructing on undivided property want to file stay order

We have a property and it is not divided among my brothers. One of my brothers is doing construction on a part of this property. Is it possible to file a stay order for the portion of property he is constructing? Please suggest. Thanks

It is not possible to advise correctly without properly going through the case.
