Marriage without Registry need separation
29-May-2023 (In Divorce Law)
I got married in a temple with full procedure. I stayed with my in-laws and husband for 2 and half months. And now I am staying separated since 15 days. My marriage is not registered. What is the procedure to get a separation legally and how shall I proceed.
You want to Leave your husband you have not described whether the marriage was Solomon iced or not or whether they have accepted you as a wife or not or some witnesses were present or not at the time of the marriage ceremony which was performed and Temple anyhow if you want to get rid from your husband you have to file a divorce petition against him in the court of law
Marriage with due custom and rituals in the society is a legal marriage. You can file for divorce before court and it can be either mutual, if both of you are willing or else it can be contested divorce which will be filed by you on some specific grounds. Sir, Non-registration of marriage does not nullify marriage. If the couple have lived together with intention and purpose and meaning of marriage then they are considered as married couple. You can do mutual divorce or any of the party of the couple can file divorce petition before the court.
