marriage registration not done still want divorce
16-Aug-2023 (In Divorce Law)
couple is married as a hindu rituals, but never registered in court. They have only lived together for 8 months. Due to conflict, now they live separately. It has been 4 year now since separation. Can that marriage be canceled or voided? Is that marriage still active? Can one of them move forward and marry again (to 3rd person)? How does the court looks at? What steps would clear and how long could it take?
The marriage is still valid and only after taking divorce any one can go for second marriage and thereafter marriage will null and void for other details you need to contact with me and for other purpose also
Once a couple is married as per Hindu rituals, they have to seek the divorce from the court of competent jurisdiction only. It makes no difference whether the marriage was registered or not. It also immaterial whether they have lived together for 8 months or for the lesser period. The sa9id marriage cannot be cancelled or declared void. In fact, the only remedy is to seek divorce/divorce by mutual consent. If any one of them move forward to marry a third person , that marriage will not be a valid /legal marriage.
Dear sir,
The marriage is still active and can not be made void however you can go for divorce under hindu marriage act, No one can marry unless you both obtain divorce from court and it would be punishable offence . Divorce proceedings may take from 2 -3 years of time

Parties are living separately does not mean marriage is dissolved. It is still legal marriage though not registered and none of them can remarry without obtaining decree of divorce from the competent court.
The marriage still exists . No spouse can remarry until divorce is granted by the court court. You can either opt divorce by mutual consent or contested divorce. Divorce by mutual consent will b time saving and faster if your spouse is ready for it.
