Marriage not registered is divorce necessary

I got married in 2012 , v hv fights for one year ,in July2014 he went abroad, v have no conversation but still I waited for himhim that one day he will come back but he didn't so I filed divorce case, he didnt turn up on any hearing , summons was received by his father in india, nw it's been 14 months, every time I get next date by court, marriage is not registered so divorce is necessary or I drop the case??

Madam, No need to drop the case. pursue the case get the summons served through high Commission of India of that country if you know the address. In the alternative you can file case for maintenance under Section 125 Cr. P. c against your husband. You can also take resort to the provisions of Protection of women from domestic Violence Act for maintenance and residential needs.

Yes divorce is much necessary for future life don't drop your case from the court. But you should need to try better way to process summons and services on your opposite party. If he not appear than you can proceed your case ex party. And getting divorce. For more information you can call me

As per Hindu marriage Act registration of marriage is not compulsory; although for certain official documents its required but for statutory recognition it's not required, in your case also registration is not necessary and your marriage is valid and required a proper divorce from Court for legal separation. U have filed divorce application in court it established that u are married till other deny it.
In Hindu marriage if marriage has been performed by saptpadi or other Hindu rites it is not necessary to register it.
Now one year has been passed, and summon has been served.there for it is sufficient time for grant divorce.

Do you have arrange marriage with rituals or not .do you have photographs and card to proove your marriage.if you have all these so you can file divorce and generally app opponents wants delay in proceedings so they try to respond in delay so don't worry .push your lawyer to do things regularly.
