Also my councelling is on going in women cell. And he is just told to give divorce in thana. Now I am living with my parents because he is not allowing me to stay with him. Do the working women(with good income) has right to apply for maintenance on divorce basis? And when should I apply for it? Please let me know the section for that. Kindly suggest.

Instead of focusing on maintenance from your husband, you should make a sound strategy to counter the contents of divorce case and this is very pivotal. In case he gets divorce on the grounds of cruelty, it will affect your further prospects. Police and women cell officials are also there to totally misguide you. Be wary of your rights.

Yes, if your income is not sufficient to fulfil your needs , and give you the same standard of life which you have had if you were married to him, then surely you can claim maintenance. You will find good supreme court and high courts judgments on this.
