Maintenance case pending since 3 years as husband absents every time

Hello there, This is for my sisters case which is pending since 3 years. My sister's husband assaults his wife and kids regularly. Kids are really scared of him. He had thrown wife and kids out of home. Kids are 13 year old boy and 11 year old girl. She filed maintenance case against her husband in the month of march 2015. He owns a home which is registered on his mothers name. He has own business. But he says he doesn't own a home to the judge in court. Judge asked for evidence. He has been absent to court many times saying his father is sick. And the case is being postponed.I badly need an advice to close this case soon.
