Maintenance case december 2022

In 2022 dec my husband left me nad my son at the airport. On January 2024 I filled for maintenance. Later he filled divorce case. My son is getting to 18.can i get his education fees etc along with mymaintenance. How long it will take to get maintenance?

As you have mentioned in your problem that your husband left you and your son at the airport and after this you have filed a case against your children for maintenanceAnd a divorce case has also been filed by your husband. At present your son is 18 years old and is studyingSo in such a situation, it is your husband's legal duty to bear the expenses of your child's education and also your maintenance. The court will definitely consider this and will make your husband pay all these expenses

Actually maintenance case includes demand of the intreme maintenance as well as finally alimony , it compensate your substances and child education and other charges. you can dand property rights and also after getting majority the offspring of your husband can demand inheritance right.

hello mam it's very sad heartening that you are facing such situation. You can get maintenance for your son even if he is 18 years old. The court first decide interim maintenance which takes usually 3 to 6 months. Then permanent maintenance decided. thanks Himanshu Singh Chauhan

yes sure if your son getting 18 complete. now full adult then he can file a suit for maintenance in the court under maintenance act 1956. it's a separate suit. no effect from your maintenance case. for more information you can contact us.
