Maintenance case and their issues

05-Jan-2023 (In Divorce Law)
Earlier my dad used to bear my expenses but three months back my dad passed away and being a patient I need my medicines and treatment. But as usual my husband is not interested to give single penny to me. Because of gulcomma and brain issues I am not able to work then how will run my life? I need financial support. What should I do that judge favour me.

If the behaviour of your husband is intolerable towards you then you can always file for divorce against him. You have got so many options. You can also file for maintenance under section 125 CrPC or a DV case against your husband and in-laws and claim your monthly maintenance. For more legal assistance I am just a call away.

In your case you must file maintenance case under CrPC and If already a maintenance petition is pending in the court then an interim maintenance petition is filed and court after going through facts and circumstances of your case may grant reasonable interim maintenance to you.

You seem to have grounds for seeking maintenance from husband. However it is not possible to give a full opinion based on statement of facts given here, a detailed discussion is required prior to giving a fuller opinion.
