basically if any Indian Citizen takes citizenship of any other country then his or her Indian citizenship gets cancelled in India.. Hence in that case Your wife can't file a dowry case. Also Dowry Case can't be filed after the completion of 7 years. But as her parents are living here there might be possibilities of filing other criminal cases against you. I would suggest to go for a mutual divorce. And pass her your message by sending her a legal notice to her first.

To be precise, yes your wife and in-laws can and would most probably file false cases as is apprehended by you. Therefore the best you can do is to get the optimal legal strategy to deal with the potential cases back in India and then go forward with your actions in a safer manner.

Yes, your wife or her family members can file a dowry harassment case (under Section 498A of the Indian Penal Code or related laws) against you or your parents in India, even if you are living abroad. However, to address such a situation: Preventive Steps: Gather all evidence of your interactions with your wife and her family (e.g., communications, financial records, and proof of good conduct). If there is a chance of misuse, consider filing an anticipatory bail application in India to protect your parents from immediate arrest. Legal Defense: If a false case is filed, you can challenge it in court by presenting proof of your innocence. Courts in India often scrutinize false dowry cases closely. Your parents may file a quashing petition in the High Court if the allegations are baseless. Divorce Filing in Canada: While you can file for divorce in Canada, be aware that the Indian courts may not recognize the judgment if it does not adhere to Indian matrimonial laws. Ensure your lawyer examines the jurisdiction and validity issues.

Yes, they can. It is an age old tactic used by disgruntled wives and their families, but it can be defended vigorously in today’s day and age. Before filing for divorce, create evidence that no dowry was ever given. Furthermore, if required and/or possible file an FIR against the wife before filing for divorce.
