Limitation period of appeal the divorce decree in Supreme Court
10-Jan-2025 (In Divorce Law)
Hi,
Limitation period of appeal in Supreme Court against high court divorce decree starts from when? Does it starts from the day of judgement or receiving the decree ?
For example : HC passed divorce order on 20 October -24then other party has to appeal against this order in Apex court by 20 January 25. Am I right ?
Limitation to file any appeal commence from the date of receiving the certified copy of the Decree sheet. The limitation period to file any appeal against the order of the High Court is 90 days from the date of receiving the copy of the Order by the party. For any further query feel free to contact
Thanks
In cases involving divorce law, the limitation period for filing an appeal in the Supreme Court against a High Court's divorce decree is 90 days, as prescribed under Article 136 of the Indian Constitution.
The limitation period begins from the date the party receives a certified copy of the judgment or decree, not necessarily the date of the judgment itself.
