If an indian citizen marries in india and divorce his/her dual citizen holder partner overseas, will that divorce be considered in india? Both are hindu
By the comity of nations certain rules are recognised as common to civilised jurisdiction. Such recognition is accorded on considerations of justice equity and good conscience. Hence a foreign judgement would be conclusive, leaving exceptional circumstances e.g where a judgement was not given by a competent court, where the judgement was devoid of merits, where the judgement was obtained by fraud etc.
