41A is not an offense rather it is a notice of the service of offence. anyway you might need to obtain bail at the first instance. taking bail is not accepting your liability. the next step would be to check if the case can be quashed. and finally to see how to conduct the trial so that you either get discharged or acquittal as the case may be. regards, Tanmoy Chattopadhyay, M.Sc (Net), LL.B (Delhi), Advocate, Hon'ble High Court, Calcutta.

you should come to the court with the 41 notice, get bail, then have a date, and the procedure will go with the flow, nothing to worry about. but you should have to come to the court in every date, as you are the principal accused, and ya, your wife will file another 2 cases, based on maintenance and divorce in near future also

You should file a suit for restitution of conjugal rights to bring back your wife which will help you in your criminal case also. If your wife refuses to come back then the court will automatically ask both of you to get a mutual divorce which will save your time also. Then the criminal case will also be withdrawn by the wife.
