Jst want a divorce from my husband

My husband is adamant of not giving me divorce...even he cut his nerves in my home for the sake of propaganda!! He even mortagaged my jewellery n took money from my mother... I dnt want anything from him.... Jst divorce!! And my jewellery too!!!

dear client if you have filed the divorce petition what is the stage of your case as per your query you have written that the jewelry has been mortgage to your mom and has taken the money it means that the jewelry is in your custody ie ur mom please do contact us for further assistance as ur query is a bit incomplete

if he is not ready to divorce you then in that case you can have a contested divorce against him under any of the grounds mentioned in section 13. if you don't want to cohabit with him then no one even court can't force to live with him. Kindly contact us for further details

you can get divorce from your husband but according to the provisions of hindu marriage act you have to prove the allegations and grounds of the divorce According to the hindu marriage act you can take divorce on certain grounds mentioned in the section 13 A of hindu marriage act. I have seen your query carefully and found that you can file a petition against your husband for divorce on the ground of cruelty but for the purpose of proving the cruelty you have to file criminal complaint against your husband under section 498A IPC and 3/4 dowry act first and then file a petition against your husband under domestic violence act. Thereafter you should file petition for divorce.
