Is the marriage even legal if there is no legal documentation of same
29-May-2023 (In Divorce Law)
I’m a Christian girl got married to a Sikh guy in 2018 at a gurudwara in east Delhi. Got separated in just 3 months due to emotional and physical abuse. Have not taken any Legal action towards him. We don’t have any legal documentation of the marriage apart from the wedding card and pictures. Is the marriage even legal? If so then after how many years of separation can the marriage be deemed void or null? I wish to move out of the country and I don’t want this to hold me back as he is not willing to file for a divorce. Will my marriage be legal abroad or I’d be considered single there?
hello client as you are willing to move out of this marriage then in tht case there is no way to move out of marriage without filling a divorce petition in the court. i can help you in a manner that if your husband need not to come to court for divorce proceedings the you can get divorce in an exparte form tht is totally valid divorce .. round the globe. in this manner you will be free from your current marriage as presently there no way in which marriage can be decleared null and void due to time .
first of all, the indian law recognises this kind of marriage as well.
secondly it depends on the country what their law says about this scenario.
thirdly you might have to disclose them whether you’re married or not
and in indian context you are
your husband based on your marriage ceremony proofs and that you lived him can file a suit (case) for restitution of conjugal rights i.e. his rights on you as your husband
