Is Marriage certificate necessary for filing petition in court?

What if my husband has the original marriage certificate and is not willing to give the same to me . DO i Require original certificate to file a petition?

Do not worry at time of filing you do not need original. You can file xerox copy stating that it is with your husband. Court will automatically ask him to for it. There is nothing to be much worried about.

There are are a number of Act under which you can get married in India. First you have to look under which Act you are getting married. In case of Hindu Marriages Act it is not needed but in case of Special Marriages Act u may need it at the time of evidence.

As per the details provided by you I would suggest that first make it clear what petition you are filling in the court although in any case if you don't havr original documents in your custody you can very clearly state that facts before the court and if atleast you have the details you state it in your applications filed before the court it's nothing to worry.

Yes, of course madam please go to your marriage registrar's office, contact him and apply for certified copy. You will get it after paying a required fees and observing some simple formalities. Its a simple procedure, don't afraid.

I think you can get Duplicate Copy of Marriage Certificate by way of application in proper process from the Marriage Officer or From the Office where your Marriage Certificate was issued. In such situation Date of Registration will be needed.
