Is it necessary to prove remarriage of husband
12-May-2023 (In Divorce Law)
I have been living separately with my husband as he asked me to leave my matrimonial house in 2011. Later i came to know that he had remarried in 2015/16 without divorce from me and they are having a girlchild out of wedlock I had filed a case and he had submitted his reply denying remarriage and reqested to quash the allegations and subsequently the case. In the above mentioned condition i have been asked by my advocate to bring evidence for my husband's remarriage. Is it necessary for me to bring the evidence.
Yes madam, it is absolutely necessary to produce your evidence that your husband has remarried. The onus of proof is upon you to prove that your husband has remarried. Please feel free to call us for further details.
If u are unable to produce documentary evidence, then u can prove the remarriage by oral evidence also. What case have u filed?? Mention that first. If it is divorce, then you can prove it by adducing oral evidence of relatives of ur husband, but if u have filed a case for the offence of bigamy, evidence must be strong
Yes...definitely u need to prove the remarriage of your husband...you made the blunder by filing the proceeding without any proof in hand..your husband is so clever in denying such allegations..you have to obtain these proofs immediately and also ask for maintenance and domestic violence...you need to contact me for further detsils otherwise you may loose your case for not getting such proofs
