Is Divorce necessary if marriage is not registered?

My friend married a girl in 2013 in bangalore.. But they didn't registered.. But they both have all the proofs like wedding photos .wedding cards and the witness like friends and the advocate. Bit the girl is now thinking that she would marry someone else without getting the divorce so let me know tht divorce is necessary and any problem occurs in future if they didn't get the divorce and simply move on..

Yes the divorce is very much necessary whether the marriage is registered or not, if she marries without obtaining divorce from the court then the said marriage entered into by her will be null and void and will have no value in eye of law and will also amount to any offence under bigamy.

Yes. Registration of Marriage is not that much mandatory. But when the marriage was solemnize and the same is followed by a proof as you mentioned it, is presumed that the marriage is took place. That is the sufficient document to prove the marriage.

Here she cant directly marry some other without legally separated from the present relationship. Divorce is compulsory.

Whether registered or not a marriage performed as per custom is recognised and valid as per Law. Therefore, she has to get a divorce if she is to marry some one else. If her husband is also willing they can go for mutual consent divorce. If husband is not willing to give a divorce, then she has to obtain divorce.
