Involking 125CrPC in a case where basic requirement law is not mention

In 125 CrPC, filed she has not mentioned that either her husband neglected her or he refused to give maintenance. She mentioned only that "at present he is not giving me any maintenance". I feel by such wordings, Rule 125CrPC is not invoked.Kindly provide me advice.

maintenance is interim maintenance or permanent maintenance under 125 crpc she has not alleged that her husband is neglected to maintain or refused to mention this is a strong point your income proofs will be needed

sec 125 crpc is maintainable and she can getting maintenance on her grounds. you can given only some citation to court for your wife living separately willfully that's shy she not entitled for maintenance.
