My father in law and mother in law who are habitual drunkard started abusing me day and night for dowry, they started torturing me to bring money from my parents. Being in pressure my father gave them 2 lakh rs. but that was not enough for them. his father used to hit me in drunk situation and tried to rape me many times .my husband used to do sex with outside girls. my situation was getting more pathatic. i managed to come lucknow to my parents on 4th sept 2016. he sent me a notice on conjugal right and that i am short tempered. i already filled a case in lucknow court but he is not accepting the court orders. can he take one sided divorce in mumbai? wht shud i do
As far as one sided or in legal phraseology called as Ex parte ,court may grant ex parte decree of divorce condition :if other spouse does not appear before the court even upon effective service of summons intimating the case filed by the petitioner seeking divorce .How ever this is with certain riders : such decree can be set aside by the other spouse if She wants to contest within 90 days from the date of decree or from the date of receipt of decree .
so you need not to worry regarding this .
Regarding your query related to notice of conjugal rights you can assign saids reason when case is contested ,with that he can't ignore or defy the case you had filed because as per law women can file case of matrimonial dispute at place of her residence .For further query you are free to contact ,always welcome !

You have multiple remedies in these circumstances. You must file FIR for dowry demand and other sections of penal code. Your case is very strong. He can not take divorce one sided. You should file divorce also if he has not filed. In fact consult a local lawyer. I can refer if you wish.
Yes it can be possible as any one can file a divorce suit which can be granted as ex parte if u want to keep an eye on it u can check it online if it was on the court website as it usually in lucknow and if you wish to get it transfer to lucknow on having a knoldwge of the same u can file a transfer application in supreemcourt as well
Dear concerned
You need to file 498A , 323 IPC followed by domestic violence. You should speak with the investigation officer who should get NBW'S for your husband and family once done he can be arrested from Mumbai ad well.
Also you should file a application for transfer of the case at the honble supreme Court without delay your husbands case will be transferred to lucknow. He will certainly get tensed once his matter is transferred and he can not take ex party order as well.

As you didn't mention which type of case you file against him
Secondly wheather he takes intishiative to summons you or you file first and besides this your question of one sided divorce court first summoning you three times then it will be little strict and inspite of all efforts if he proove that you disobey the court they can done it one sided but it takes time
