If wife do not want to sign in divorce paper as she will never remarry

20-Oct-2023 (In Divorce Law)
My brother file a mutual divorce file. He wanted to give a 2 lakhs rupees at the time of final hearing which is clearly written in the submitted pitition. But his wife asked for giving the money before appearing in the court. How can we understand the hearing is final or not before the judgement and there is no guarantee she will come on the court. The advocate asked us to give money in a put up date of the case. Though the put up date is not mentioned in the case status. I think they wanted to cheat us. What can we do now?

as per the mou if it is agreed that she will accept the said consideration and she doesnt turn up seek permission from the judge and serve notice through court and if she fails then even the court will take necessary steps accordingly but i somehow feel your lawyer is in hand in gloves with your wife for which you are suffering, very unfortunate then

It is necessary to know the fact in details because after filing of mutual consent divorce, the next date will be fixed after six months, that is for evidence as well as for final disposal if both parties agree. If your brother wishes to take my Legal opinion professionally upon online payment, then can contact.
