I was married in Feb 2021 as hindu Law, I had 2 affairs before marriage. My hubby knows about them. My last Bf after 1 week of marriage threaten my hubby and inform him that me & he both did court marriage (which is False), I also kept demanding for divorce as I thought it will be difficult to manage marriage responsibilities. I left matrimonial house aftr 3 mnths marriage stating I will file DV& Dowery case if he don't gave divorce, then aftr 1 mnth I tried to go back. my hubby denied to accept me and wants to proceed for mutual divorce, also he has recording of threatening with my bf and call details, Its being 1 year we are separated. He stated that he enough evidence like voice recording of divorce demanding and call details My husband has filed divorce case on the basis of cruelty after 1 year of separation. What i can do?? Also do the call and voice recording can be considered as evidence??

Dear Client, In that situation you should approach court and file case before Court as in 125 Cr.P.C. , Section 12 DV Act, and Section 24 of Hindu Marriage Act and as per recording part is concern it will not be admissible before court numbers of Judgements in that regards so for more clarity you may contact us then I'll elaborate properly about your case. your husband is sufficient ground for divorce because separation of more than 1 year is also a ground of divorce. and the other thing that voice recording is admisible or not the answer is its depends upon the court who admit it or not. if you dont want to divorce him you can linger on the divorce petition which has been filled by your husband and you have many another option to distrub your husband.
