I was married as per hindu law in Feb 2021, I had 2 affairs before marriage. My hubby knows about them. My last Bf after 1 week of marriage threaten my hubby and inform him that me & he both did court marriage (which is False), I also kept demanding for divorce as I thought it will be difficult to manage marriage responsibilities. I left matrimonial house aftr 3 mnths marriage stating I will file DV& Dowery case if he don't gave divorce, then aftr 1 mnth I felt mistake & tried to go back. my hubby denied to accept me and wants to proceed for mutual divorce, also he has recording of threatening with my bf and call details, Its being 1 year we are separated. He stated that he enough evidence like voice recording/call details
Can I file DV case now. Should I file 498a case so he will full fill all my demands.
Also do the call and voice recording can be considered as evidence??

basicly it is necessary for DV act both the parties live together because how can you proved Domestic violence but in your case you are separated about 1 year. You can file dv act but the value of that case is not believeble by the court. so in my consent that filing of DV act is waste of money and time you can file maintenance and dowry case against him.

in your first marriage you already have discussed and disclosed everything with your husband but after your existing marriage if you are involved with your boyfriend its not good for your relationship and you already said that your boyfriend is saying to your husband that you have done court marriage with him and he has proofs disclosed that your husband has your recordings and chats if this is proved true , it can be harmful for you so what I request to go for a legal advice .
