I want to part away from my wife.

I am tired with psychological torture and humiliation from my wife. Everytime i tried to address the problem in view of children but now it's non tolerable anymore. How I can get divorce from my wife if she is not willing to part away?

Well, if your Wife is not Divorcing you, then, you can file a case of Unilateral Divorce against her on certain grounds. These grounds can be Unleashing Mental and Physical Cruelty upon you, Adultery, Unlawful and Unjustifiable Desertion.

You can file Contested Divorce in the court from your side. If she appears in the court after receiving court summons it will be taken up as per the process and if she denies to appear then we can also take exparte order and proceed with the case.

If she is not willing to part ways amicably by taking mutual consent divorce then you have the option of filing contested divorce petition on the ground of mental cruelty meted out to you by your wife. You may file contested divorce petition in the court having jurisdiction.

Well, if your Wife is not willing to part away with you by Divorcing you, then, you can file a Unilateral Divorce Petition against her to seek One Sided Divorce or Unilateral Divorce on the basis of the concerned grounds like Adultery, Illegal and Unawful Desertation, etc
