I want divorce from my husband, and he also wants same, i have a 12 years old daughter. I want to know that what are the rights of a women after divorce and the custody of my daughter.
If both of you want to file for divorce , then you both together can get divorce by mutual consent. The other rights you have is claiming monthly maintenance , alimony etc and you may ask for custody of your daughter.

in this case you both can proceed for mutual consent divorce petition wherein you can decide the custodial rights of the daughter. recently higher courts decided that father had less participation in upbringing of adolescent daughters therefore it is advisable that you should keep the custody and give him access to the daughter

Well, You can either seek Mutual Divorce under Sec 13B of the Hindu Marriage Act, 1955 , if both of you are ready to seek Divorce from one another or can seek Contested Divorce if your Husband is not willing to Divorce you. You can seek Maintenance under Sec 125 of the CRPC and can seek Custody of your child too.
