I GS 38/F dependent since marriage with 2 children 4 yrs old and 10 yes old boys.1.)Husband is absconding after filing a false case of divorce 13 ( 1 ) against wife (me) filed in January23 .2.)FIR filed after 3 months of complaint as medication failed in mahila thana and fdrc counseling. He is in bihar his native place. He is not coming to court for DV/ maintenance/divorce cases filed July 23.How long he can hide.FIR sec 377 498A 504 506 323 filed 6th oct 23. I want interim maintenance soon

Dear Client, It's a Court discretion to decide your interim maintenance in pursuance of Neha Vs Rajnish judgment passed by Supreme Court or you may try to approach High Court for expeditiously disposal before Allahabad High Court.

dear client as per your query I can only suggest that what is the status of the case he has filed did you appear in that or you have filed your detailed written statement and what you have filed as section 24 which is interim maintenance it takes time if he is not appearing court can take cognizance against it against him for future paid consultation please contact us with your relevant documents.

As you have mentioned in your problem that you have filed a case against your husband under Section 377 498 IPC Bed Domestic Violence and your husband has also filed a divorce case in the court but after filing the divorce case, Aisi is not coming to the court nor is he coming to your caseIn such a common situation, he should get the notice issued by the DPO in proper manner and if he comes to the court after receiving the DPO's report and receiving his notice, then he can apply to the court for interim maintenance under Section 23
