I want Divorce/Alimony from my husband but he is not ready to give any

I have filled a case but I am working and ill also. And my husband never gave a single penny to me. Neither he is interested to give me maintance. Instead of showing his salary proof he showed my ITR, which he got it illegally . Do i have a right to get maintance ?

yes you have right to maintaince.... you show his income proof and proof of your illness both parties need to file detailed income and expenditure affidavit as per guidelines issued by high court from time to time depending upon that it will be decided

Yes you can file a maintenance petition against him in the court of law and under the provisions of law, it is a moral duty an obligation of your husband to maintain you. Secondly, if he is not willing to divorce you then you file a contested divorce on various grounds, applicable to your facts and circumstances.

Maintenance will depend upon the salary and standard of living of the wife. If the wife is earning sufficiently to maintain herself then she cannot claim maintenance. But if the situation is different then she can claim maintenance under section 125 CrPC. For more legal assistance I am just a call away.

Yea you do have a right to get maintenance even if you are working. You need to file for a divorce along with a petition under sec 125 for maintenance. Please feel free to get in touch for further discussions.

When u have already filed a case in the court and your advocate is working on it then why do u need online advice n get more confused. Let your advocate do his work & if u r not satisfied with his work only the proceed with others ..
