I want divorce to divorce my husband

I want to divorce my husband. We have a 5 year old daughter. He always abuses me and says that I am not capable for a highly qualified person like him. We are married for 10years. Some times he questions me what degree or percentage I have. It was a love marriage and he knew my degree and profession before marriage. I was working till 2019 Sep and left the job after that for taking care of my daughter and my FIL who is 90yrs old living with us from past 2 years. My husband always abuses me and always trying to make me feel inferior. I am completely depressed and worried for my daughter's future as she is growing up seeing our finghts. We have frequent fights. I told him that we can mutually separate and take care of our daughter. But he is not agreeing. Please help me how can I move forward with divorce or separation.
Well, you can either pursue for Contested Divorce or You can seek Judicial Separation from Court. From what you said, I don't think so, your Husband will agree for Mutual Divorce. Therefore from either above mentioned options , you can choose

Divorce by Mutual consent is good way to separate legally if both agree for it. Otherwise as you have mentioned that your husband is not agreeing for it, you have to file petition for contested divorce in court wherein you may ask for maintenance and alimony for yourself and for daughter. Hope you have income details of your husband to claim alimony.

first you have to send notice with all fact s. wait for reply from the other side. If or otherwise the reply will not come even though you can file the divorce petition against him in appropriate court . if you are Hindu then you can file your petition under Hindu Marriage Act or special Marriage Act.
