13-Oct-2023 (In Divorce Law)
He file case u/s 9. Marrige was on july16 with Hindu act in sep 16 we both made affidavit to live sepratly .or the original marrige certificate hand over to me. Now he send me notice u/s 9.how can i (she) face.i want devote him permanently.
You should file an appropriate reply to the petition filed and then convince the court that there is no ground for restitution to be allowed. Let the court decide then if the motion is to be allowed or not. Usually the court rejects the motion.
well as per your query you got married as per hindu rights and customs and your husband filed the application for restitution of conjugal right under section 9 and now u want divorce from your husband u can contact me for further proceeding regarding filing of case
You need to appear before court and file your reply, with reasons for not living jointly. After that you can file divorce and police complaint simultaneously. Then you will be separated permanently. Best of luck
