I WANT A LEGAL DOCUMENT BETWEEN ME AND MY BABY'S BIOLOGICAL FATHER

I am 24, Unmarried and pregnant.I want to make a legal document between me and my baby's biological father that he do not have any right on my baby. He and I never disclose anywhere that the child belongs to him. Is it possible to have this on legal papers?

Child born out of an unmarried relationship is termed as legitimate child and mother can claim the exclusive guardianship of the child. Here the child can be in absolute custody and right of a mother and the same can be drawn on MOU and also can file a petition in appropriate forum to claim the absolute and exclusive guardianship of the child. Hi,
While it is not uncommon in western countries for biological fathers to sign an affidavit waiving paternity, the law in India is not clear on the validity of such a document. Either way, an important consideration is that the right to know one’s biological father has been recognised by Indian courts so even if such a document is entered into, the child has the right to know the identity of the biological father which cannot be contracted out of.

Yes…you can always make a settlement agreement with the biological father and get it notarised and write in that he can’t claim any rights over the child and other conditions as may be applicable. For more legal assistance I am just a call away.

There can be a settlement deed between u both regarding who will keep this child after birth. However, we need more facts on this case to understand the legalities …kindly b in touch with us asap to proceed further with the documents
