Both spouses agree to separate and jointly file a petition, requiring a cooling-off period (e.g., 6 months) before a final decree. Contested Divorce: One spouse files against the other, citing specific grounds like cruelty, adultery, desertion, or mental/physical abuse, requiring proof in court.

Before sending a divorce notice, you must first decide whether you are seeking mutual consent divorce or contested divorce. Generally, a legal notice is sent through an advocate stating the facts of marriage, issues between parties, grounds for divorce, and a request for reconciliation or mutual consent. If there is no response or settlement, you can file a divorce petition before the Family Court having jurisdiction (place of marriage, last residence, or wife’s residence). In mutual consent cases, both parties file jointly and attend two motions. In contested cases, evidence and trial will follow. Sending a notice is not compulsory in law, but it helps show your bona fides and may lead to amicable resolution before court proceedings.
