I got married on 21 feb 2021 it's getting worse

06-Jun-2023 (In Divorce Law)
Sir I got married on 21 feb 2021. I dropped her to her home town on 12 April as she wanted to spend some time with her parents after marriage. Every thing was fine for few days. One day I checked her almirah and found that she took all the gold jewellery with her whatever she got as gift in the marriage. When I questioned her she said that she doesn't want to stay with me for random reasons and she doesn't want to file divorce from her end she wants to live like this only. She said if I want to do legal process I can do it and she would sign the legal papers I never wanted a divorce I loved her a lot always but I can't live like this for a life time. I have tried everything in these 2 months to bring her back. But I don't think she wants to be with me. please advise if I can take divorce on mutual consent. What would I need to do?

Divorce cannot be filed before completion of one year from the marriage according to the Hindu marriages Act. After one year, if both parties are ready then divorce on mutual consent ground can be filed. As of now you should send a legal notice.

Well, you should seek a Mutual Divorce. If she has already made up her mind to give Divorce, then you cannot do anything. Despite that, try to change your Wife's mindset through your mutual friends and relatives, if it works, great. Otherwise, seek a Mutual Divorce and get your Jewellery back.

hi in this case if you like her then it is not advisable that you should take divorce instead of that you can proceed to file suit for restitution of conjugal rights wherein you can get order from the court against her to reside with you
