If he is not agreeing to Divorce you, file a case under Sec 9 of the Hindu Marriage Act, by filing a Petition for Conjugal Rights. He has to state the reasons in court, why he is not making Physical Relations despite Marrying you, if he will not be able to give concrete justified reasons with evidence, you will be granted Divorce by the Court.

As per matrimonial laws , it should be atleast a year for solemnisation of marriage after which you can file for divorce. Since your marriage is solemnied on 6th january 2021, you have to wait till january 2022 for filing divorce. But if you have some other reason which could be the ground for nullity them , you may file petition for nullity of marriage even now.

you can durectly file a case for divorce under cruelty or any other ground from your side and dont have to wait for your husbands response and also you can claim maintenance on a monthly basis from him so that he shall the understand the nature of the situation
