I got divorce on December-2021. My son (5 yrs age ) with his mother.

Mera talak December-2021 me ho chuka h. Mera son, wife ke paas hi h. Aaj uski age 5 years 4 months h. Me son ko apne sath rakhna chahta hu. Kya mujhe apna son mil jayega. Please guide kijiye.

welfare of the chield agar aap sabit kar denge ki aap k saath hai, to aap ko mil sakta hai. saath hi ye ki, bachce ka ma k saath rahna kyo uchit nahi, jab ki wo bhi oos ki natural guardian hai. aap ko apni story poori batani hogi, oos k baad hi ye bata sakta hu ki , aap ko bachcha dilwa sakunga ya nahi.

Yes u can take the custody of ur child as he has attained the age of 5 years. The court will se that where the welfare of the child is best possible if u can prove in court that u can take the care of ur child then the custody will be given to u.
