I don't want to give divorce notice

Please tell me that after 5 month of marriage husband gives the divorce notice to wife ?

Yes if suppose there is ground of cruelty or torture either it may be physical or metal cruelty or torture by any of the party they can move with legal notice as per the provisions of Hindu Marriage Act.

He can give Divorce Notice. But legally, Mutual Divorce cannot be granted before the expiry of the period of one year from the Date on which Marriage got executed. Moreover, during such one year, Husband and Wife should not have indulged in Sex.

It depends on situations, but for mutual consent divorce you have to live seperately for one year of period. if your husband refuses to stay with you then you can file petition for restitution of conjugal rights.
